Our Cases: Professional Negligence

When dealing with a health care or legal professional, a high level of expertise and conduct is expected. But what happens when professional negligence or malpractice occurs and clients or patients are damaged or harmed by the professional's performance-or lack thereof? Proving this negligence can be a difficult task.

The Law Offices of Frank L. Branson has considerable experience and proven results in the area of professional negligence including that of health care professionals (doctors, nurses, therapists, hospital staff, etc.) and legal professionals.

Professional Negligence Cases:

SURGICAL NEGLIGENCE/QUADRIPARESIS
When errors during cervical fusion neck surgery left a school secretary a quadraplegic, her family retained Frank Branson to sue the surgeon, his clinic and business partners. The parties agreed to pay an eight figure settlement to resolve the matter.

“Before Theresa’s settlement, she was dependent on Medicaid. After the settlement and during the last year of her life, she was able to afford a van and around-the-clock medical care. The work Mr. Branson’s firm did allowed for her to have some independence and a feeling of peace. She didn’t have to worry anymore about how she could pay her bills. “My sister could not have had better lawyers.”—Barbara McIntyre, Theresa’s sister

MEDICAL NEGLIGENCE/FAILURE TO DIAGNOSE HYPOGLYCEMIA IN NEWBORN
Richard Beeson, age 4, suffers from brain injuries, including cerebral palsy and cortical blindness because his low blood sugar was not properly diagnosed at birth. His father, a lawn care provider, and his mother, a teacher, sued for medical and nursing malpractice in Witchita Falls federal court, claiming gross negligence.

“What Mr. Branson’s firm obtained for our son gives us the comfort to know that no matter what happens to my wife and I in the future, Richard will always be taken care of. In fact, we believe the fact that the Branson firm had our case doubled the amount of the settlement. Maybe in the future, there will be a cure for Richard’s helpless condition, and we will be able to afford that cure.”—Rick Beeson, Richard’s father

NURSING NEGLIGENCE/BRAIN DAMAGE
Teenager Daniel Williams’ blow to his head during a water polo game has resulted in a disastrous future. Medical negligence on the part of the hospital means he is brain-damaged for life.

“We were concerned about pursuing a corporation as large as the hospital. I was given Mr. Branson’s name by two different people in two different towns. The size of the hospital didn’t bother them. The firm kept its promises, and Daniel’s life is better because of that.”—Donna Thresher, Daniel’s mother

MEDICAL NEGLIGENCE/IMPROPER CARE AND PLACEMENT OF FEEDING TUBE IN INFANT/IMPROPER RESUSCITATION
A home health care nurse tried to insert a nasal gastric tube in a two week old baby and the infant went into cardiac arrest. Resuscitation efforts failed, and he died while his helpless teen mother looked on.

“I am thankful that a firm of Mr. Branson’s caliber would stand up and fight for me."
—Monica Ramos, the baby’s mother

BLINDNESS CAUSED BY EXCESSIVE OXYGEN
After the defendants refused to offer the family any compensation, a Bowie County jury found that three physicians and a hospital were responsible for blinding an infant through the use of excessive oxygen.

HOSPITAL FACES MULTI-MILLION DOLLAR LAW SUIT
Dallas Morning News (9/19/97)

A Dallas County jury awarded millions in damages against Baylor Medical Center in Garland after finding it grossly negligent in failing to prevent the beating death of a pharmacist.” Jerry White, an attorney with the Law Offices of Frank L. Branson, who represented the victim’s family, said, “To describe what they had out there as a security system is a farce.”
